A RESOLUTION OF THE MIAMI SHORES VILLAGE COUNCIL, MIAMI
SHORES VILLAGE, FLORIDA, AUTHORIZING THE VACATING OF
CERTAIN PORTIONS OF N.E. 5TH COURT,AND PORTIONS OF N.E. 89TH
STREET, IN MIAMI SHORES VILLAGE, RESERVING EASEMENTS FOR
EXISTING UTILITIES IN PLACE, PROVIDING FOR ADDITIONAL
CONDITIONS AND PROVIDING FORAN EFFECTIVE DATE.
WHEREAS, The principals/owners of Tropical Chevrolet, have petitioned the Miami
Shores Village Council to vacate certain portions of N.E. 5th Court and N.E. 89th Street, adjacent
to the Tropical Chevrolet properties, as set forth in the sketch attached hereto; and,
WHEREAS, The Village Council deems the roadways at issue to be no longer required for
public use and the vacation thereof to be in the public interest; and,
WHEREAS, Through traffic use of this roadway constitutes a hazard to the heavy
pedestrian traffic associated with Tropical Chevrolet's operations; and
WHEREAS, It appears that the petitioners should be granted the relief requested,
NOW, THEREFORE, BE IT RESOLVED, that the application for vacation and
abandonment of the roadway(s) at issue is hereby conditionally approved, and the Village
Manager is hereby directed and authorized to execute such documents as may be reasonably
necessary to effectuate such abandonment and vacation, including Quit Claim Deeds in favor of
the applicant, at such time as the applicant has satisfied the following conditions:
1) The applicant secures and files with the Village letters of"no objection"to the requested
abandonment from all applicable utilities using the right of ways at issue, provided,
nevertheless, that this Resolution shall in no manner affect the right of easement in and to said
roadways for any public utility erected or situated therein on the date of the adoption of this
Resolution;
2) The applicant agrees in writing to provide utility easements, if required by a utility or to
accommodate existing utilities in such a manner as may be required by said utilities;
3) The Applicant submits and files with the Village a "Final"traffic study confirming the findings
reflected in the"Draft"traffic study contained in the application;
4) The Applicant submits and files with the Village a signed and sealed survey, certified to the
Village, delineating the proper and accurate legal description for each parcel of roadway(s) to
be abandoned;
5) The applicant fulfills all representations or offers of payment of compensation to the Village
as consideration for the Quit Claim of any property interest of the Village in the roadway(s) to
be abandoned, by paying a mutually agreed upon figure based on a certified appraisal, of the
roadway property.
6) The roadway vacation will specifically exclude Parcel 4 and the mirror image of Parcel 4 due
west on the attached survey.
This approval will lapse and become invalid unless all conditions of approval contained herein
are fulfilled and the abandonment and vacation is fully effectuated within one year of the date
of this resolution.
This Resolution shall become effective upon its adoption.
