R-1080-04 RESOLUTION NO. 1080-04 A RESOLUTION OF THE MIAMI SHORES VILLAGE COUNCIL AUTHORIZING ADVANCES TO THE CHARTER SCHOOL AUTHORITY FOR PURPOSES OF MAKING PAYMENTS TO THE EXECUTIVE DIRECTOR AND FOR BASIC START-UP COSTS OF THE DOCTOR'S CHARTER SCHOOL OF MIAMI SHORES, PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the Miami Shores Village Charter School Authority, created under Chapter 2, Article VI, Sections 2.90 et seq. of the Village Code, is moving forward, in accordance with its mandate, to establish plans for the creation, staffing and operation of the Doctor's Charter School of Miami Shores, which is anticipated to open with the school term commencing in the fall of 2005; WHEREAS, the Board of Directors of the Charter School Authority has prudently determined that the time line for the opening of the Charter School requires the hiring of an Executive Director at the earliest possible date to perform the necessary executive functions to pursue the mission of the Authority; WHEREAS, prior to the opening of the Charter School and until such time as funds become available from county or state sources to operate the school, there is a need to compensate the Executive Director for work performed with respect to the Charter School and to allow for payment of basic start-up costs in advance of such funding; and WHEREAS, the Charter School Authority does not currently have a dedicated funding source for such expenses and the Board of Directors of the Charter School Authority has requested that the Village advance such funds to the Charter School Authority for the purposes of compensating the Charter School's Executive Director and to pay basic start-up costs, with such funds to be repaid to the Village, without interest, at such time as alternative funding sources become available to the Charter School; NOW THEREFORE, be it resolved by the Miami Shores Village Council, that: Section 1. The Village administration is hereby authorized to make financial advances to and for the benefit of the Charter School Authority, as requested by the Board of Directors of the Charter School Authority, for the purpose of providing funds to compensate the Charter School's Executive Director for services rendered and to pay for basic start-up costs prior to such time as the school's regular operating funds become available from county or state sources, all in accordance with the provisions of this Resolution. Section 2. The total amount of funds authorized to be advanced for the purpose described herein and pursuant to this Resolution shall not exceed $175,000. Section 3. The Village Administration shall require, as a precondition of any advances provided for under this Resolution, that the Miami Shores Village Charter School Authority execute and deliver to the Village an agreement in a form satisfactory to the Village Attorney and duly authorized by the Board of Directors of the Miami Shores Village Charter School Authority, acknowledging that all such payments from the Village are advances to be repaid by the Charter School Authority, without interest, from non-Village funding sources, as part of the Charter School's opening year operating budget (unless repaid sooner). Section 4. This Resolution shall become effective immediately upon adoption. PASSSED AND ADOPTED THIS 20th DAY of July, 2004.
