R-0906-93 RESOLUTION NO. 906-93 A RESOLUTION OF THE MIAMI SHORES VILLAGE COUNCIL URGING THE DADE COUNTY COMMISSION TO FURTHER REVIEW COUNTY ORDINANCE NO. 93-14 PERTAINING TO REQUIREMENTS FOR CERTIFICATION OF STRUCTURAL PLANS EXAMINERS BECAUSE OF THE FINANCIAL BURDEN THEREBY PLACED ON MUNICIPALITIES AND REQUESTING DELAY OF EFFECTIVE DATE OF SAID ORDINANCE TO ALLOW FOR THE REQUESTED REVIEW. WHEREAS, Dade County Ordinance No. 93-14 requires munici- palities to employ certified structural engineers to serve as municipal structural plans examiners , thereby eliminating authority for municipalities to employ architects or licensed general contractors with five (5) years of experience within the jurisdiction of the South Florida Building Code to serve in this capacity, and WHEREAS, the aforementioned change will not insure the quality of workmanship and materials used in construction as evidenced by the destruction by Hurricane Andrew of several major commercial developments that had their plans reviewed by the Dade County Certified Structural Plan Reviewers , and WHEREAS, the new requirements aforesaid will pose a question of municipal liability for structural and design adequacy and assume the higher qualification of the reviewing engineer working for a municipality than that for a design engineer, and WHEREAS, the effective date of said Ordinance requires the hiring of said engineer within the current fiscal budget year when there are no budgeted funds available for this purpose, therefore BE IT RESOLVED BY MIAMI SHORES VILLAGE: Section 1 . The Dade County Commission is vigorously urged to review County Ordinance No. 93-14 with regard to the financial impact thereof on municipalities as well as other implications affecting the operational capabilities of municipal building departments . Section 2. That the effective date of said Ordinance be appropriately deferred to allow a reasonable period of time for the requested review. PASSED AND ADOPTED this 20th day of April 1993 .
