RESOLUTION OF THE MIAMI SHORES VILLAGE COUNCIL
DIRECTING THE VILLAGE MANAGER TO DEFER
NEGOTIATIONS FOR EXTENSION OF CABLE TELEVISION
FRANCHISE UNTIL SUCH TIME AS THE FEDERAL
COMMUNICATIONS COMMISSION ADOPTS RULES AND
REGULATIONS IN ACCORDANCE WITH THE PROVISIONS
OF THE CABLE TELEVISION CONSUMER PROTECTION
AND COMPETITION ACT OF 1992 .
WHEREAS, Storer Cable Communications of South Florida, Inc. ,
the current single cable television franchisee in Miami Shores
Village, is seeking to renew its franchise agreement which expires
March 21, 1994, and
WHEREAS, the Cable Television Consumer Protection and
Competition Act of 1992, recently adopted by the United States
Congress, will materially affect the powers of municipalities to
regulate certain aspects of cable television, and
WHEREAS, the full effect of said legislation will not be
determined until the Federal Communications Commission (FCC)
ultimately adopts rules and regulations in accordance with the
provisions of the Act,
NOW THEREFORE, BE IT RESOLVED BY MIAMI SHORES VILLAGE, that
the Village Manager shall extend negotiations for renewal of the
single existing cable franchise, or any new applications therefore,
until such time as the FCC does in fact adopt the rules and
regulations required as a result of the enactment of the Cable
Television Consumer Protection and Competitive Act of 1992.
