R-0882-91 RESOLUTION N0. 882-91 A RESOLUTION OF THE CITY OF MIAMI SHORES VILLAGE, FLORIDA, REQUESTING RELIEF FROM PARTICIPATION IN THE COLLECTION OF BUILD- ING CODE COMPLIANCE FEES ON BEHALF OF DADE COUNTY AS CURRENTLY PROPOSED IN THE REVISIONS TO CHAPTER 8 OF THE METROPOLI- TAN DADE COUNTY CODE AND PROVIDING FOR TRANSMITTAL. WHEREAS, the Dade County Grand Jury Report filed May 15, 1990 as it related to the Board of Rules and Appeals recommended the separation of the Building Code Enforcement Office from the Dade County Building and Zoning Department; and WHEREAS, Dade County has passed on first reading an ordinance providing a separate funding source for the newly created department by establishing a building code compliance fee; and WHEREAS, each municipality collecting the compliance fees will be allowed to retain one and one half percent of the fees to cover administrative costs; and WHEREAS, Miami Shores Village is an older built-out Dade County Community with minimal building activity which will create a minimal amount of code compliance fees; and WHEREAS, Miami Shores Village can document that the collection of these code compliance fees as currently proposed will actually cost Miami Shores Village money in excess of the amount of the administrative fee allowed; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, DADE COUNTY FLORIDA AS FOLLOWS; 1. That prior to second reading of this ordinance Dade County reconsider the needs of municipalities with minimal building construction activity and take all actions necessary to minimize the administrative burden borne by these communities up to and including allowing such municipalities to opt out of participation; amending the reporting require- ments to quarterly reporting; establishing a minimum threshold of $500 in fees collected prior to requiring reporting, and/or any other effective measures; and 2 . The Village Manager is hereby authorized to transmit copies of this resolution to the Dade League of Cities and the members of the Dade County Commission.
