R-0876-91 -SOLUTION NO. 876-91 A RESOLUTION EXPRESSING THE INTENT OF THE VILLAGE OF MIAMI SHORES TO INCUR GENERAL OBLIGATION DEBT OF THE VILLAGE IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $1 ,000,000 TO PAY THE COST OF CONSTRUCTING A NEW PUBLIC SWIMMING POOL, IF SUCH ISSUANCE IS APPROVED BY A MAJORITY OF THE QUALIFIED ELECTORS OF THE VILLAGE ; CALLING FOR A SPECIAL ELECTION TO BE HELD SIMULTANEOUSLY WITH THE GENERAL ELECTION SCHEDULED FOR APRIL 9, 1991 ; PROVIDING THE METHOD AND MANNER FOR NOTICE OF SAID REFERENDUM; AND APPROVING THE FORM OF SAID BALLOT. WHEREAS, the Village of Miami Shores (the "Village" ) under the authority granted by the Constitution and the laws of the State of Florida, Including Chapter 166, Florida Statutes, Is authorized to Issue general obligation debt to provide funds to pay the cost of constructing a new public swimming pool ; and WHEREAS, the Council of the Village has determined that the Issuance of general obligation debt Is in the best Interest of the taxpayers In the Village in order to replace the Village's public swimmwing pool which is worn out beyond repair ; and WHEREAS, it is necessary for the Village to call a special election to submit to the qualified electors resid- Ing in the Village the question of the Issuance of general obligation debt , and to prescribe the method and manner of holding the eleciton, to provide for notice thereof , and to approve the form of ballot to be utilized in the election. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL: Section 1 . The Village Council hereby authorizes the Issuance of general obligation debt In the form of ( 1 ) general obligation bonds, or ( 11 ) a participation In the Florida League of Cities bond program, or ( 111 ) a lease/purchase or ( Iv) any other similar Indebtedness In an aggregate principal amount not to exceed $1 ,000,000 to pay the cost of constructing a new public swimming pool if such Issuance is approved by a majority of the qualified electors in the special election to be held simultaneously with the general election scheduled for April 9, 1991 . The Village will utilize the type of general obligation Indebtedness which will result In the lowest cost to the Village and Its citizens If such debt Is approved by the electors. The Indebtedness with Interest will be secured by the _ full faith and cre t of the Village and the Village shall Impose a special m.. Ilage to raise additional valorem taxes specifically for such purpose. Section 2 . Notice of the election will be published In the Miami Herald, a newspaper of general circulation In the Village of Miami Shores, at least twice prior to election week, once In the fifth week which commences on Sunday, March 3, 1991 , and once In the third week , which commences on Sunday, March 17, 1991 . The date of the first publication in the week of March 3 , 1991 , shall be at least thirty (30) days before the election. Notice shall be substantially In the following form: NOTICE OF SPECIAL ELECTION FOR ISSUANCE OF GENERAL OBLIGATION DEBT OF THE VILLAGE OF MIAMI SHORES TO BE HELD ON APRIL 9, 1991 As approved by Resolution No. duly passed and adopted by the Village Council of the Village of Miami Shores on a scheduled election will be held on April 9, 1991 for the purpose of submitting to the qualified electors of the Village the following question : Shall the Village of Miami Shores Incur general obligation debt through general obligation bonds or other similar Indebtedness secured by the Village's full faith and credit In a principal amount not to exceed $1 ,000,000 to pay the cost of constructing a new public swimming pool to be owned by the Village provided that such general obligation debt shall not bear Interest at a rate in excess of the maximum rate permitted by law and mature no later than 2011 ? The polls at the election will be open from 7:00 o'clock a.m. until 7:00 o'clock p.m. of the same day. As provided by the applicable Village of Miami Shores ordinances and State Statutes, the following polling place is hereby designated for the special bond election which polling place may be changed by the Dade County Supervisor of Elections as provided by law. C. LAWTON McCALL COMMUNITY CENTER In accordance with the Constitution and election laws of the State of Florida, and the ordinances of the Village of Miami Shores, all qualified electors of the Village of Miami Shores, Florida, residing in the precincts set forth above, shall be entitled vote In the special bond ectlon to which notice pertains. The books of registered voters are maintained by the Supervisor of Elections of Dade County, Florida, and said books will close at 5:00 o'clock P.M. on March 8, 1991 . The Village shall be authorized to Issue the bonds covered by the question set forth above when such Issuance as set forth in the question has been approved by a vote of a ma- Jorlty of the qualified electors of the Village (Precinct (s) of the Village of Miami Shores, Florida) . The special bond election will be conducted simultaneously with the general election by the election officers selected and appointed by the Dade County Supervisor of Elections and will be held at precinct(s) C. Lawton McCall Community Center which is the same polling place for regular City elections held In the Village of Miami Shores, Florida. The registration books for voting at said re- ferendum shall close at 5 :00 o'clock p.m. on March 8, 1991 , which is thirty (30) days before the date of said referendum, but the books shall remain open for all subsequent elections. Section 4. The Village Clerk Is hereby designated and appointed as the official representative of the governing body in all transactions with the Supervisor of Elections of Dade County In relation to matters pertaining to the use of the registration books and the holding of said special bond election . The Village Clerk shall transmit a certified copy of this Resolution to the Supervisor of Elections of Dade County, and such supervisor is hereby requested to prepare and supply the necessary ballots, return forms, and other paraphernalia for use in connection with such referendum to the various election officials, to prepare and supply the necessary absent voters' ballots and envelopes for mailing to voters property requesting the same, and to arrange for the appointment of the election boards to serve at said referendum. Section 5. The ballot used at the election for voting on the questions submitted shall be that portion of the cardboard or paper or other material within the ballot frames of the voting machines which shall contain a statement of the 0 question submitted The ballot as It appears within the ballot frames of the vot . ag machines shall be subst_ntlally in the following form: OFFICIAL BALLOT SPECIAL ELECTION FOR ISSUANCE OF GENERAL OBLIGATION DEBT FOR PAYING THE COST OF CONSTRUCTING A NEW PUBLIC SWIMMING POOL Shall the Village of Miami Shores Incur general obligation debt through general obligation bonds or other similar Indebtedness secured by the Village's full faith and credit in a principal amount not to exceed $1 ,000,000 to pay the cost of constructing a new public swimming pool to be owned by the Village provided that such general obligation debt shall not bear Interest at a rate in excess of the maximum rate permitted by law and mature no later than 2011 ? FOR BONDS AGAINST BONDS Section 6. The electors desiring to vote for or against the Issuance of the Bonds shall punch the appropriate box on the ballot card containing the words "FOR BONDS" or "AGAINST BONDS" . Section 7. The ballots containing the question set forth in Section 5 above shall be prepared for the use of ab- sent electors entitled to cast such ballots in the election . Section S. The Village Council shall meet at o'clock p.m. on 1991 , at the regular meet- Ing of the Village Council and shall declare the result of said referendum.
