A RESOLUTION OF THE VILLAGE COUNCIL OF MIAMI
SHORES VILLAGE OPPOSING THE PROPOSED RULE FOR
RETROFITTING EXISTING STORMWATER SYSTEMS AS
SET FORTH IN THE STATE WATER POLICY,
SECTION 17-40.420.
WHEREAS, the proposed rule provides for a different approach
to the comprehensive plan as set forth in Florida Statutes 163, and
WHEREAS, local governments are presently studying the techno-
logy presently existing to accomplish the requirements of the pro-
posed rule, and
WHEREAS, municipalities are unable to determine the effect the
proposed rule would have on the comprehensive plan of local govern-
ments, and
WHEREAS, the financial Impact of the proposed rule to comply
with retrofitting is prohibitive unless Florida State Legislation
would authorize additional funds as the funds presently available
from the South Florida Management District are Inadequate, and
WHEREAS, in the City of Miami Shores Village the cost of retro-
fitting would exceed $240,000, and
WHEREAS, it is necessary for the United States government and
the Florida Legislature to provide adequate funds for stormwater
retrofitting before the adoption of any proposed rule,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE OF MIAMI SHORES
VILLAGE :
Section 1 . The Village opposes the State
Water Policy as set forth in
proposed rule Section 17-40.420
requiring retrofitting of
stormwater facilities .
Section 2 . The Village hereby endorses the
efforts of the Dade League of
Cities and the Florida League
of Cities in opposing the
adoption of the proposed rule
Section 17-40.420.
Section 3 . The Village Manager shall forth-
with cause copies of this resolution
to be forwarded to the Dade League
of Cities, the Florida League of
Cities, the State of Florida Depart-
ment of Environmental Regulation
and others deemed appropriate.
