A RESOLUTION OF THE VILLAGE COUNCIL OF MIAMI SHORES
VILLAGE, FLORIDA URGING THE FLORIDA LEAGUE OF
CITIES, INC. AND ALL LOCAL GOVERNMENTS TO REQUEST
MEMBERS OF THE FLORIDA CONGRESSIONAL DELEGATION
TO CAUSE THE DEPARTMENT OF LABOR TO CEASE AND
DESIST IN THE INEQUITABLE ENFORCEMENT OF THE FAIR
LABOR STANDARDS ACT AGAINST MUNICIPALITIES.
WHEREAS, the Department of Labor has commenced, in
audits of municipalities and other local governments of its
canine and motorcycle units, to require the payment of
back wages, and
WHEREAS, the resulting effects on municipalities, in
some instances, approach one hundred thousand dollars, and
WHEREAS, police canine officers are generally paid a
salary differential and the motorcycle officers are permitted
to utilize the motorcycle to and from work, and
WHEREAS, in addition to the above the Enforcement Agency
is requiring supplemental compensation, and
WHEREAS, local governments economically are being forced
to accept the rulings of the Department of Labor as the cost
of litigation would far exceed the liability for overtime,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
MIAMI SHORES VILLAGE, FLORIDA THAT:
Section 1. the Florida League of Cities and
all local governments are urged
to take immediate action to cause the
Department of Labor to cease and desist
in the inequitable enforcement of the
Fair Labor Standards Act against
municipalities.
Section 2. the Village Manager shall cause copies
of this resolution to be sent to the
Florida League of Cities, Inc. , all local
governments of Dade County, and each
member of the United States Congressional
Delegation from Florida.
